      FREQUENTLY ASKED QUESTIONS

      1. I received discharge. Do I need a record suspension?

You need to apply for a record suspension only if you were convicted of a criminal offence in Canada. You do not need a record suspension if you were discharged.

      2. What is the waiting period for a record  suspension application?

Five years for summary offences and ten years for indictable offences. You need to have completed your service and paid your fines.

      3. My charges did not result in conviction.  Should I take action?

If your charge was withdrawn, you were acquitted, or found not guilty, your may qualify to have your record expunged. This is different than a record suspension. Contact us for assistance.

      4. I received a record suspension in Canada. Do I still need a USA entry waiver?

Yes. If you are criminally inadmissible to the U.S.A. you still need a an advance permission- a waiver.  Contact us for advice. Your case will be handled by a licensed USA lawyer.
